Dans sa présentation de l’ouvrage, Michel Meyer, directeur de la collection «L’interrogation philosophique», décrit le «tour de force» que représente cette édition critique de La rhétorique ou l’art de parler de Bernard Lamy — travail jugé autrefois «impossible» par Geneviève Rodis-Lewis. Elle remplacera avantageusement les deux éditions en facsimilé, celle de 1969 par l’University of Sussex Library et celle de 1980, aux éditions Wilhelm Fink à Munich, seules disponibles jusqu’alors. Mais pour qui? Lamy nous le dit lui-même dans sa préface: (...) «Mon ouvrage [...] ne regarde pas seulement les orateurs, mais généralement tous ceux qui parlent et qui écrivent, les poètes, les historiens, les philosophes, les théologiens». De nos jours, cette nouvelle édition intéressera surtout les historiens des idées et les philosophes du langage. Kim Sang Ong-Van-Cung se donne ici pour objet l’histoire du concept de la création—l’histoire de sa mutation de concept purement théologique chrétien en concept métaphysique avec Descartes. Fort juste cause: on sait à quel point la lecture non informée des Méditations offre matière à distorsion et à fausse interprétation; et tout ce qui replace un texte dans son contexte d’idées est à encourager. Toutefois, l’exposé historique et critique du concept de la création cède la place à la défense des thèses (...) multiples et complexes de l’auteure, qui se meut avec une érudition stupéfiante chez les anciens, les modernes et les postmodernes. Au fil des chapitres, les thèses sont reprises sous différents angles au lieu d’être mieux étayées. Cet ouvrage est frustrant et décevant, car on y devine à la fois des thèses originales et un objectif valable dans l’histoire des idées, mais les thèses ne parviennent pas à se communiquer et l’objectif n’est pas atteint. La passion indéniable que l’auteure exprime à chaque instant pour le sujet ainsi que les connaissances encyclopédiques impressionnantes qu’elle démontre à chaque page sont prometteuses de futurs travaux où un meilleur effort de vulgarisation mettra les idées à la portée d’un public mieux défini. Everything about Derrida suggests that he is for a radical reform or transformation of language, whilst Wittgenstein seems to vindicate a fidelity to ordinary language and to want to 'expunge' from language the 'metaphysical use' of words. But just how opposed are they? My contention in this paper is that Wittgenstein does not 'deconstruct', as some critics have rather loosely suggested, because, as we shall see, the expunging of metaphysical use favoured by Wittgenstein does not amount to the deconstruction of (...) metaphysical appurtenance practised by Derrida. However, there are interesting parallels to be drawn between the two philosophers which I shall try to articulate in the course of this paper. The first part provides the background, in Wittgenstein's writings, to his concept of 'metaphysi cal use'; the second is an exposition of what Derrida refers to as 'metaphysical appurtenance' and attendant notions such as those of binary oppositions and of the labouring of concepts; and the third is a summing up and a defence of the thesis that Wittgenstein does not, in any full-bodied sense of the term, 'deconstruct'. Currently, although the implementation of corporate social responsibility (CSR) practices and its incorporation into business strategies is emphasised widely in developed countries as a key to sustainable growth and economic profitability, this term is still new to the Vietnamese market because of the low awareness of the importance of CSR practices, which leads to the failure of many firms. Since Vietnamese firms do not prioritise CSR implementation, Vietnam is experiencing an increasing shortage of skilled employees owing to a lack of (...) motivation. Therefore, this study examines the relationship between the corporate strategic objective (CSO), CSR practices and employee commitment, to provide recommendations to enhance motivation. This study used a quantitative approach and data from a questionnaire delivered to 869 enterprises in 2019 in Vietnam. Results suggest that the CSO had direct and indirect effects on employee commitment through the mediation of CSR practices. (shrink)

There are a good many insights in Schouls’s book, which is definitely not for first-time readers of the Meditations but for scholars who think they know it all. After reading Schouls’s essay, they will find, however, that where theirs was a vague, mostly negative notion of the understanding, gathered from the famous “wax example,” as the faculty which provides the information the senses can not, Schouls offers a detailed model of the faculty of the pure understanding. In this essay, Schouls (...) has wrought a delicate piece in which each element of the Cartesian clockwork kicks in at the right time to result in a system in which it is the human mind’s nature to bring about progress through science and in which the human essence, mind, ultimately expressed in the freedom of the will, is best realized in science. One drawback that can perhaps be pointed out already is that Schouls makes the Meditations sound like a transcendental argument in favour of the pursuit of science: scientific certainty exists, what does human nature have to be like for this to be possible?, etc. True, Descartes did mean the Meditations to be the foundation for science so that we can “make ourselves, as it were, the lords and masters of nature”, but it was not his intention to start from the premise that Science is possible. He thought he was establishing whether any certainty whatsoever could be achieved. (shrink)

Ils complètent dans un premier temps la cartographie de ce mode [DRO] et retracent le rôle joué par celui-ci dans l’Enquête de Latour. Dans un deuxième temps, ils s'interrogent sur les croisements et les harmoniques que génère ce mode [DRO] avec d’autres modes d’existence, notamment celui que Latour appelle [ORG] – le mode (...) d’organisation éthique, sociale, commerciale. Ils articulent alors les difficultés posées par ces croisements et ces harmoniques, mais aussi ses aspects prometteurs pour l’avènement d’un nouveau droit de la Terre.The authors here reflect on the law as one of the modes of existence of the Moderns, as described in Bruno Latour’s An Inquiry into the Modes of Existence. They first seek to complete the cartography of this mode [LAW] and to retrace the role played by [LAW] in Latour’s Inquiry. Second, they reflect on the crossings and harmonics at play between [LAW] and other modes of existence, notably [ORG]—the mode of the ethical, social or commercial organization. Malgré le développement des droits de l’homme et l’apparition d’une justice pénale internationale, la mondialisation lance de nouveaux défis à l’humanisme juridique : durcissement du contrôle des migrations, aggravation des exclusions sociales, multiplication des atteintes à l’environnement, persistance des crimes internationaux « les plus graves », risques d’asservissement créés par les nouvelles technologies. Humaniser la mondialisation renvoie à trois objectifs : résister à la déshumanisation, responsabiliser les acteurs, anticiper sur les risques à venir. Pour y contribuer, il faudrait une mutation (...) de la notion d’ordre juridique car le modèle souverainiste (ordre international), postulant l’autonomie de chaque État, est dépassé. Mais l’universalisme (ordre supranational), comme l’ultra-libéralisme (ordre transnational), risquent de conduire à l’impérialisme du plus puissant. Le droit à la sûreté soumet l’État au droit tout en pouvant légitimer des atteintes aux libertés, apparemment contraires à l’État de droit. On propose d’analyser ici les mutations de l’État de droit, notamment depuis la pérennisation de l’état d’exception après 2001 et l’apparition de régimes de suspicion, comme l’expression de trois processus juridiques distincts de suspension, de contournement et de détournement. Il s’agit aussi de rappeler comment, au-delà de la distinction entre politique autoritaire et libérale, un double mouvement, interne (...) et international, de constitutionnalisation et d’internationalisation des systèmes de droit, constitue un ferment de résistance, limité mais déjà effectif, à toute raison d’État. This paper proposes several recurrent neural network-based models for recognizing requisite and effectuation parts in Legal Texts. Firstly, we propose a modification of BiLSTM-CRF model that allows the use of external features to improve the performance of deep learning models in case large annotated corpora are not available. However, this model can only recognize RE parts which are not overlapped. Secondly, we propose two approaches for recognizing overlapping RE parts including the cascading approach which uses the sequence of BiLSTM-CRF models (...) and the unified model approach with the multilayer BiLSTM-CRF model and the multilayer BiLSTM-MLP-CRF model. Experimental results on two Japan law RRE datasets demonstrated advantages of our proposed models. For the Japanese National Pension Law dataset, our approaches obtained an \ score of 93.27% and exhibited a significant improvement compared to previous approaches. For the Japan Civil Code RRE dataset which is written in English, our approaches produced an \ score of 78.24% in recognizing RE parts that exhibited a significant improvement over strong baselines. In addition, using external features and in-domain pre-trained word embeddings also improved the performance of RRE systems. (shrink)

The implementation of inclusive policies is largely dependent on teachers´ willingness to accommodate students with special educational needs (SEN) in mainstream classrooms, which is affected by their perceived competence and attitudes. This study investigated attitudes of pre- and in-service teachers toward students with two types of SEN: challenging behavior and learning difficulties. The three components of attitude (affective, cognitive, and behavioral) were assessed using indirect and direct measures. Results revealed that teachers held negative implicit attitudes toward challenging behavior and learning (...) difficulties, however implicit attitudes did not vary as a function of the type of SEN. Ratings of the stereotypical dimensions warmth and competence and overall ratings of scholastic achievement were affected by professional status and type of SEN. Professional status, implicit attitudes and stereotypical knowledge together explained 52 and 43% of the variance in teachers´ ratings of academic proficiency for students with challenging behavior and learning difficulties, respectively. Results are interpreted within the theoretical framework and implications for teacher training are discussed. (shrink)

This Article takes the perspective of law and philosophy, integrating insights from computer science. First, I will argue that in the era of big data analytics we need an understanding of privacy that is capable of protecting what is uncountable, incalculable or incomputable about individual persons. To instigate this new dimension of the right to privacy, I expand previous work on the relational nature of privacy, and the productive indeterminacy of human identity it implies, into an ecological understanding of privacy, (...) taking into account the technological environment that mediates the constitution of human identity. Second, I will investigate how machine learning actually works, detecting a series of design choices that inform the accuracy of the outcome, each entailing trade-offs that determine the relevance, validity and reliability of the algorithm’s accuracy for real life problems. I argue that incomputability does not call for a rejection of machine learning per se but calls for a research design that enables those who will be affected by the algorithms to become involved and to learn how machines learn — resulting in a better understanding of their potential and limitations. A better understanding of the limitations that are inherent in machine learning will deflate some of the eschatological expectations, and provide for better decision-making about whether and if so how to implement machine learning in specific domains or contexts. I will highlight how a reliable research design aligns with purpose limitation as core to its methodological integrity. This Article, then, advocates a practice of “agonistic machine learning” that will contribute to responsible decisions about the integration of data-driven applications into our environments while simultaneously bringing them under the Rule of Law. This should also provide the best means to achieve effective protection against overdetermination of individuals by machine inferences. (shrink)

Nursing migration: global treasure hunt or disaster‐in‐the‐making?International nurse migration — moving from one country to another in the search of employment — is the focus of this article. The majority of member states of the World Health Organization report a shortage, maldistribution and misutilisation of nurses. International recruitment has been seen as a solution. The negative effects of international migration on the ‘supplier’ countries may be recognised today but are not effectively addressed.Nurse migration is motivated by the search for professional (...) development, better quality of life and personal safety. Pay and learning opportunities continue to be the most frequently reported incentives for nurse migration, especially by nurses from less‐developed countries. Career opportunities were considered key incentives for nurses emigrating from high‐income countries. Language was reported to be a significant barrier. The positive global economic/social/professional development resulting from international migration needs to be weighed against a substantial ‘brain and skills drain’ experienced by supplier countries. The vulnerable status of migrant nurses is also of concern in certain cases. The focus on short‐term solutions as opposed to resolving the problem of a worldwide shortage of nurses causes great concern. Recent initiatives attempt to curb or channel international recruitment. The delicate balance between recognising the right of individual nurses to migrate and a collective concern for the health of a nation’s population must be achieved. (shrink)

Within science technology and society studies the focus has long been on descriptive microanalyses. Several authors have raised the issue of the normative implications of the findings of research into socio-technical devices and infrastructures, while some claim that material artifacts have moral significance or should even be regarded as moral actors. In this contribution the normative impact of technologies is investigated and compared with the normative impact of legal norms, arguing that a generic concept of normativity is needed that does (...) not depend on the intention of whoever designed either a law or a technology. Furthermore this contribution develops the idea that modern law, which has been mediated by the technologies of the script and the printing press, may need to rearticulate its basic tenets into emerging technologies in order to sustain what has been called the paradox of the 'Rechtsstaat'. The contributions to this volume focus on the issue of privacy, which is often equated with data (...) privacy and data security, location privacy, anonymity, pseudonymity, unobservability, and unlinkability. Here, however, the extent to which predictive and other types of data analytics operate in ways that may or may not violate privacy is rigorously taken up, both technologically and legally, in order to open up new possibilities for considering, and contesting, how we are increasingly being correlated and categorizedin relationship with due process – the right to contest how the profiling systems are categorizing and deciding about us. There is a prominent phenomenon in the religious life of Vietnam, which is the emergence of “new religions”. These phenomena have not only made the religious space of the nation more complex and multi-dimensional but also challenged stability and sustainable development within the religious communities in this key economic region. Having studied the new religious phenomenon in recent years, we have noted its progress and widespread characteristics within the ethnic communities. While it may appear that "new religion" is a simple (...) and gentle concept and practice, it is in fact, intrinsically related to and has significant implications on the social life of the community members. However, there is a growing concern, considerable suspicion and anxiety with regards to its impacts on individuals, families, social and cultural traditions, beliefs and religions; many have opined that it is radically changing the peaceful cohabitation of diverse religious traditions, revealing a potential for conflicts across groups. Based on the religious reality of the Southern region of Vietnam, the Center for Religion Studies has implemented a project regarding new religions in Ho Chi Minh City and the problems faced by the religious policy in Vietnam. . Three logical squares of predication or quantification, which one can even extend to logical hexagons, will be presented and analyzed. All three squares are based on ideas of the non-traditional theory of predication developed by Sinowjew and Wessel. The authors also designed a non-traditional theory of quantification. It will be shown that this theory is superfluous, since it is based on an obscure difference between two kinds of quantification and one pays a high price for differentiating in this way: (...) losing the definability between the existence- and all-quantifier. This book offers an innovative approach to the analysis of the current crisis in the South China Sea. Moving beyond the spirit of the UN Convention on the Law of the Sea (UNCLOS), the mechanisms of which are limited to physical geography, it demonstrates how epistemological insights from the field of critical realist philosophy can reveal the importance of cultural and structural conditioning processes in social interactions, processes which shape the conditions for the emergence of crisis points along a spectrum (...) of conflict and cooperation. The potential for conflict resolution and the emergence of new regions in Pacific Asia much depends on the nature of such interactions at many levels (political-economic, semiotic and cultural) based on perceptions of what constitutes the "common" versus a Sinicised version of "Lebensraum". This timely book tells the story of the smart technologies that reconstruct our world, by provoking their most salient functionality: the prediction and preemption of our day-to-day activities, preferences, health and credit risks, criminal intent and spending capacity. Mireille Hildebrandt claims that we are in transit between an information society and a data-driven society, which has far reaching consequences for the world we depend on. She highlights how the pervasive employment of machine-learning technologies that inform so-called ‘data-driven agency’ threaten (...) privacy, identity, autonomy, non-discrimination, due process and the presumption of innocence. The author argues how smart technologies undermine, reconfigure and overrule the ends of the law in a constitutional democracy, jeopardizing law as an instrument of justice, legal certainty and the public good. Finally, the book calls on lawyers, computer scientists and civil society not to reject smart technologies, explaining how further engaging these technologies may help to reinvent the effective protection of the rule of law. In this contribution, I will argue that the image of a balance is often used to defend the idea of a trade-off. To understand the drawbacks of this line of thought, I will explore the relationship between online security technologies and fundamental rights, notably privacy, nondiscrimination, freedom of speech and due process. After discriminating between three types of online security technologies, I will trace the reconfiguration of the notion of privacy in the era of smart environments. This will lead to (...) an inquiry into the metaphor of the scale, building on the triple test regarding the justification of the limitation of fundamental rights such as privacy. The conclusion will be that in the case of a trade-off, infringing measures will have to be balanced by effective safeguards. No trade-off without balance. (shrink)

Law, Human Agency and Autonomic Computing interrogates the legal implications of the notion and experience of human agency implied by the emerging paradigm of autonomic computing, and the socio-technical infrastructures it supports. The development of autonomic computing and ambient intelligence âe" self-governing systems âe" challenge traditional philosophical conceptions of human self-constitution and agency, with significant consequences for the theory and practice of constitutional self-government. Ideas of identity, subjectivity, agency, personhood, intentionality, and embodiment are all central to the functioning of modern (...) legal systems. But once artificial entities become more autonomic, and less dependent on deliberate human intervention, criteria like agency, intentionality and self-determination, become too fragile to serve as defining criteria for human subjectivity, personality or identity, and for characterizing the processes through which individual citizens become moral and legal subjects. Are autonomic âe" yet artificial âe" systems shrinking the distance between (acting) subjects and (acted upon) objects? How âe~distinctively humanâe(tm) will agency be in a world of autonomic computing? Or, alternatively, does autonomic computing merely disclose that we were never, in this sense, âe~humanâe(tm) anyway? A dialogue between philosophers of technology and philosophers of law, this book addresses these questions, as it takes up the unprecedented opportunity that autonomic computing and ambient intelligence offer for a reassessment of the most basic concepts of law. The COVID-19 pandemic introduced many restrictions to in-person interactions, and remote social interactions may be especially important for managing loneliness when such restrictions are in place. However, it is unclear how social interactions are related to loneliness when in-person interactions are limited. Data were collected between February 2021 and March 2022 from a sample of 581 university students. Participants reported their loneliness and participation in positive in-person or remote social interactions each day for 14 days. Results from dynamic structural equation (...) models showed that participants felt less lonely than they usually felt on the days they engaged in positive remote interactions at the within-person level. Moreover, participants generally felt less lonely when engaging more frequently in remote interactions, but only when in-person interactions were restricted (between-person level). Some of these results varied by changing COVID-19 restrictions. Finally, for participants who felt lonelier in general, the effect of positive in-person and remote interactions on loneliness was less strong. These findings suggest that social interactions may buffer loneliness but are not as impactful for those who experience greater loneliness. (shrink)

We emphasize the relevance to cognitive psychology of Feldman and Levin's theoretical position. Traditional views of motor control have failed to clearly separate “production control” at the level of motor command, based on task-independent CV (control variables), from intentional “product control” based on task-dependent parameters. Because F&L's approach concentrates on the first process (trajectory formation), it can distinguish the product control stage.

This discussion note does three things: it explains the notion of ‘legal protection by design’ in relation to data-driven infrastructures that form the backbone of our new ‘onlife world’, it explains how the notion of ‘by design’ relates to the relational nature of what an environment affords its inhabitants, referring to the work of James Gibson, and it explains how this affects our understanding of human capabilities in relation to the affordances of changing environments.
